AggroNav Terms of Use

1. Acceptance

By downloading, installing, or using AggroNav ("App"), you agree to be bound by these Terms of Use ("Terms"). These Terms constitute a legally binding agreement between you and Dumpster Hill, LLC ("Company," "we," "us," or "our"), a limited liability company organized under the laws of Alabama, USA.

If you do not agree to these Terms, do not use the App.

2. Updates to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date. Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.

3. What AggroNav Does

AggroNav is a one-shot location tool: you mark a single spot, and the App guides you back to it later using your device's live position and compass heading. AggroNav is not a saved-places list or route-recording tool; marking a new spot replaces the previously saved one. The App runs entirely on your device. We provide no hosting, no cloud storage, and no accounts.

4. Location Access

AggroNav requires access to your device's location in order to function, as described in our Privacy Policy. Location is only accessed while the App is open and in the foreground; the App does not request or use background location access.

5. Your Data

AggroNav does not host, store on any server, or transmit your saved spot or preferences anywhere. This information is stored only on your device and remains under your control. See our Privacy Policy for details.

6. GPS Accuracy and Limitations

AggroNav relies on your device's GPS and location services, which have inherent limitations. Accuracy varies based on your device, environment, satellite visibility, and signal conditions, and can commonly range from roughly 15 to 40 feet under good conditions, and considerably more indoors, in parking structures, near tall buildings, or in other obstructed environments.

As a result, the distance and direction shown by the App, and the App's determination of when you have "arrived" at your saved spot, are approximations and may not precisely reflect your actual position or the precise location where you originally marked a spot. AggroNav is provided as a convenience tool and is not intended for use in situations requiring precise navigation, life safety, emergency response, or any other application where GPS error could result in harm. You are solely responsible for exercising your own judgment when using the App, especially in unfamiliar, hazardous, or time-sensitive situations.

7. In-App Purchases

AggroNav's core functionality, including saving and navigating back to a marked spot, is entirely free and will remain free. One pointer character and its associated audio ("voice") is available at no cost. The App offers an optional, one-time purchase to unlock the remaining pointer characters and voices; once purchased, this unlock does not expire and does not need to be purchased again on the same account.

Separately, AggroNav offers an entirely optional, repeatable "support the developer" purchase. This is a donation and does not unlock any feature; every feature you're entitled to (including the free voice, or all voices if you've purchased the unlock) remains available whether or not you make this purchase.

Purchases are processed through Google Play Billing and are subject to Google's applicable terms and policies, including their refund policies. We do not directly process or store your payment information.

8. User Conduct and Acceptable Use

You agree not to use AggroNav for any unlawful purpose, or in any way that violates the rights of others. We reserve the right to update or discontinue the App at any time.

9. Intellectual Property Rights

All content, features, and functionality of the App itself, including but not limited to text, graphics, logos, icons, images, and software, are the exclusive property of Dumpster Hill, LLC or its licensors and are protected by United States and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes only. You may not:

• Copy, modify, distribute, sell, or lease any part of the App
• Reverse engineer or attempt to extract source code
• Remove or alter any proprietary notices or labels

10. Third-Party Assets

Certain icons and imagery in the App incorporate Noto Emoji, created by Google Inc. and used under the Apache License, Version 2.0. A copy of that license is available at apache.org/licenses/LICENSE-2.0.

11. No Warranty

AggroNav is provided "as is" without warranty of any kind. We do not guarantee that the App will be error-free, uninterrupted, or that it will successfully or precisely guide you back to a saved spot under all circumstances, including poor GPS signal, device limitations, or interruptions beyond our control. Use it at your own discretion.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY DAMAGES ARISING FROM YOUR USE OF AGGRONAV, INCLUDING BUT NOT LIMITED TO:

• Failure to locate, or inaccurate guidance toward, a saved spot
• Any harm, loss, or inconvenience resulting from reliance on the App's location or navigation output
• Any indirect, incidental, special, or consequential damages
• Any technical malfunctions or interruptions

13. Indemnification

You agree to indemnify, defend, and hold harmless Dumpster Hill, LLC and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses arising from your use or misuse of the App or your violation of these Terms.

14. Termination

You may stop using the App at any time by uninstalling it from your device. All data stored locally remains under your control.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Alabama, United States, without regard to conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the App shall first be attempted to be resolved informally by contacting us.

If the dispute cannot be resolved informally, it shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules. Each party agrees to waive the right to a jury trial and to participate in a class action or representative proceeding.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Dumpster Hill, LLC regarding the use of the App.
