1. Introduction and Acceptance of Terms

By downloading, installing, or using the Mr. Boopers mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). These Terms constitute a legally binding agreement between you and Dumpster Hill, LLC ("Company," "we," "us," or "our"), a limited liability company organized under the laws of Alabama, USA.

If you do not agree to these Terms, do not use the App.

2. Updates to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date and provide notice through the App. Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.

3. Description of Service

Mr. Boopers is a professional audio recording application with intelligent audio processing and enhancement capabilities. The App operates entirely offline and stores all recordings and user data locally on your device.

4. User Conduct and Responsibilities

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App for any illegal or unauthorized purpose
• Record conversations without proper consent where required by law
• Attempt to reverse engineer or disassemble the App
• Use the App to violate any applicable laws or regulations
• Interfere with the App's functionality or security features

You are responsible for ensuring compliance with applicable recording laws in your jurisdiction.

5. Data Storage and Privacy

All recordings, audio settings, and user data are stored locally on your device and are not transmitted to our servers. The App operates entirely offline to protect your privacy. For complete details about data handling, please review our Privacy Policy.

6. Optional Donations

Mr. Boopers is free to use. We offer an optional one-time in-app donation processed entirely by Google Play. We do not collect, store, or have access to any payment information. All transactions are governed by Google Play's Terms of Service and Privacy Policy. Donations are voluntary and non-refundable except as required by applicable law or Google Play policy.

7. Intellectual Property Rights

All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, images, audio processing algorithms, and software, are the exclusive property of Dumpster Hill, LLC or its licensors and are protected by United States and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes only. You may not:

• Copy, modify, distribute, sell, or lease any part of the App
• Reverse engineer or attempt to extract source code
• Remove or alter any proprietary notices or labels
• Republish or redistribute App content without permission

8. Limitation of Liability

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING:

• Loss of recordings due to device failure
• Any technical malfunctions or interruptions
• Quality of audio processing or enhancement results
• Any decisions based on processed audio content
• Loss of recordings or data due to insufficient device storage, including cases where in-app storage warnings fail to trigger or are not acted upon in time

9. Indemnification

You agree to indemnify, defend, and hold harmless Dumpster Hill, LLC and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses arising from your use or misuse of the App or your violation of these Terms.

10. Termination

You may stop using the App at any time by uninstalling it from your device. All data stored locally remains under your control.

11. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Alabama, United States, without regard to conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the App shall first be attempted to be resolved informally by contacting us.

If the dispute cannot be resolved informally, it shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules.

The arbitration may be conducted in person, by video conference, or through written submissions, as determined under AAA rules. The seat of arbitration shall be Alabama, United States, unless otherwise required by applicable AAA rules or law.

Each party agrees to waive the right to a jury trial and to participate in a class action or representative proceeding.

Each party shall bear its own costs and fees, except as otherwise required by AAA Consumer Arbitration Rules or applicable law.

Judgment on the arbitration award may be entered in any court of competent jurisdiction.

If any portion of this arbitration clause is found unenforceable, the remainder shall remain in full force and effect.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Dumpster Hill, LLC regarding the use of the App.
