DH Record Terms of Use

1. Acceptance

By downloading, installing, or using DH Record ("App"), you agree to be bound by these Terms of Use ("Terms"). These Terms constitute a legally binding agreement between you and Dumpster Hill, LLC ("Company," "we," "us," or "our"), a limited liability company organized under the laws of Alabama, USA.

If you do not agree to these Terms, do not use the App.

2. Updates to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date. Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.

3. What DH Record Does

DH Record is a video recording tool designed to start capturing video as quickly as possible when you open the App. Recordings are saved directly to your device's local storage. The App runs entirely on your device. We provide no hosting, no cloud storage, and no social features. DH Record does not upload, transmit, or have any access to the video or audio you record.

4. Camera and Microphone Access

DH Record requires access to your device's camera and microphone in order to function. These are used solely to record video and audio at your direction. Camera and microphone access is used only while you are actively recording within the App.

5. Your Recordings

DH Record does not host, store on any server, or claim any ownership over the videos you record. Your recordings belong entirely to you and are stored only on your device, in your device's standard media library. Settings and preferences you configure within the App remain under your control and are stored only on your device.

6. Recording Responsibly

You are solely responsible for how you use DH Record, including compliance with any applicable laws regarding recording audio or video of other people, locations, or situations. Consent requirements for recording others vary by jurisdiction; it is your responsibility to know and follow the laws that apply to you. We are not responsible for how you use content you record with the App.

7. Optional Date, Time, and Location Overlay

DH Record may offer optional features that overlay the date, time, and/or GPS location onto your recording at the moment it is captured. These overlays are provided for your own documentation and record-keeping purposes. GPS location availability and accuracy depend on your device, environment, and signal conditions, and may be unavailable in some circumstances.

We make no guarantee regarding the legal admissibility or acceptance of these overlays, or any recording made with the App, in any court, insurance claim, or other proceeding. Requirements vary by jurisdiction, situation, and how the evidence is preserved and presented. Please verify independently what is needed for your specific use and consult a qualified attorney if legal or insurance matters are involved.

8. In-App Purchases and Pro Features

DH Record may offer optional paid features ("Pro Features") available through in-app purchase or subscription. Purchases are processed through Google Play Billing and are subject to Google's applicable terms and policies, including their refund policies. We do not directly process or store your payment information. Access to Pro Features is tied to your Google Play account in accordance with Google Play's standard purchase and licensing rules.

9. User Conduct and Acceptable Use

You agree not to use DH Record to:

• Record, capture, or distribute content in violation of any applicable law or regulation
• Violate the privacy rights of others
• Use the App for any unlawful purpose

We reserve the right to update or discontinue the App at any time.

10. Intellectual Property Rights

All content, features, and functionality of the App itself, including but not limited to text, graphics, logos, icons, images, and software, are the exclusive property of Dumpster Hill, LLC or its licensors and are protected by United States and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes only. You may not:

• Copy, modify, distribute, sell, or lease any part of the App
• Reverse engineer or attempt to extract source code
• Remove or alter any proprietary notices or labels

11. No Warranty

DH Record is provided "as is" without warranty of any kind. We do not guarantee that the App will be error-free, uninterrupted, or that any recording will be captured, saved, or preserved without loss under all circumstances, including device failure, storage limitations, or interruptions beyond our control. Use it at your own discretion.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY DAMAGES ARISING FROM YOUR USE OF DH RECORD, INCLUDING BUT NOT LIMITED TO:

• Loss of recorded video or audio
• Claims arising from content you record or distribute using the App
• Any indirect, incidental, special, or consequential damages
• Any technical malfunctions or interruptions

13. Indemnification

You agree to indemnify, defend, and hold harmless Dumpster Hill, LLC and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses arising from your use or misuse of the App or your violation of these Terms.

14. Termination

You may stop using the App at any time by uninstalling it from your device. All data stored locally remains under your control.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Alabama, United States, without regard to conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the App shall first be attempted to be resolved informally by contacting us.

If the dispute cannot be resolved informally, it shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules. Each party agrees to waive the right to a jury trial and to participate in a class action or representative proceeding.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Dumpster Hill, LLC regarding the use of the App.
